Had an Accident in the Workplace in West Yorkshire?

Accidents can happen anywhere and anytime, but suffering an injury at work that isn’t your fault can be particularly upsetting.

Employers are legally responsible for the safety of everyone on their premises. They must have adequate insurance in place and they have to obey Health and Safety rules.

If you have had a workplace accident that you believe has been caused by your employer failing to meet these responsibilities, you could receive compensation by making a work accident claim.

Even if you are partly to blame for your injury, you may still be able to make a claim if your employer is found to have been mostly at fault.

At the Accident Claimline, our team in Leeds have helped thousands of victims of workplace accidents get the compensation they deserve. Our specialist Leeds-based personal injury lawyers have the experience and expertise to help get you the best possible result as quickly as possible.

What Work Accidents can you Claim for in Leeds?

You may have good grounds to make a claim for compensation if your injury has been caused by:

  • Faulty machinery at work
  • Not having protective gloves, goggles or other gear
  • Slipping, tripping or falling
  • Dangerous practices in the workplace
  • Poor or non-existent workplace training
  • Not being shown how to lift of handle things properly
  • Falling objects
  • Mistakes by a colleague at work
  • Assault by a colleague at work
  • Toxic substances in the work environment
  • Any breach of the Health and Safety rules

These are just examples. If your particular issue isn’t listed, you should still contact us and we will tell you if it might be a good basis for a personal injury claim.

You will need to prove that the issue that has caused your injury is, in turn, the result of your employer’s negligence. So, it is worth getting supporting statements from any co-workers who saw your accident. Get a copy, also, of the relevant entry in the accident logbook.

How Much is Your Workplace Accident Claim Worth?

The compensation you can receive covers a number of things. The first is the pain you are suffering. The amount you can claim will depend where your injury is and its severity.

Put simply, different values attach to different parts of the body. As a rough guide:

  • Head injuries. Minor injuries might merit compensation in the low thousands (perhaps £3,000 to £6,000) whilst work injuries that result in brain damage can result in compensation of hundreds of thousands of pounds.
  • Upper body injuries. Again, more serious injuries to the neck or shoulders that have a longer-term (or even permanent) impact might merit between £10,000 and £20,000.
  • Back injuries. These can be debilitating and claims can range from £6,000 to £20,000.
  • Arms, wrists and hands. If your prognosis is good, a claim in the low thousands is likely. If, however, you suffer permanent injury, your claim can reach £30,000.
  • Lower body injuries. If you injure your legs, knees or ankles and if you are going to suffer long-term problems, your claim can be worth up to £25,000.
  • Psychological injuries. Work accidents can be traumatic. Again, if a full recovery is likely, your claim probably will be below £10,000.  There have been extreme cases of ongoing trauma, however, where damages have reached as high as £50,000.

When assessing your claim, one of our specialist work accident lawyers will use guidelines based on previous, similar claims that have gone to Court, to give you an estimate of the value of your claim. The precise amount, of course, will depend on your particular circumstances.

You also can claim compensation for:

  • Your loss of earnings, if you have to take time off work;
  • Future loss of earnings, if you cannot return to work, or if you can only do a job that is lower paid;
  • Expenses in replacing any of your property that has been damaged by your accident;
  • Expenses you otherwise would not have, for example the cost of attending medical appointments;
  • The cost of any care that has to be arranged for you (either professional care or care provided by a family member).

Once we assess your claim fully, we can advise you what exactly we can claim on your behalf.

When Should you Start your Workplace Accident Claim?

You have three years in which you to make your workplace accident claim. If you wait longer, your claim may be time-barred and you might lose any entitlement to compensation.

The clock starts ticking from the date of your accident or from when you first realise that an issue in the work place has caused your injury.  A good example of this is if you have been exposed to asbestos - it can take years before asbestos related diseases, like mesothelioma, appear, and the time limit will start to run once you become aware of your illness.

Personal Injury Law Firm LeedsIf you are taking forward a claim for a loved one who has passed away during the process of making a claim, the deadline is measured from their date of death, giving you time to continue the claim.

How Long Does a Claim Take? (Leeds & Across England & Wales)

Every claim for compensation for a workplace injury is unique. Different claims will be settled more or less quickly than others, depending on their particular circumstances and also on how the employer that is being sued reacts.

It might be that your claim will be settled in just a few months, but more complex cases can take longer to resolve. However, you can rest assured that the Accident Claimline will be with you every step of the way, from the beginning until the end.
