If you have suffered an injury as a result of a third party’s negligence then you can make a claim for compensation. This is because the law provides that members of society have a duty of care towards each other, for example, drivers to other road users, doctors to their patients and employers to their employees. Any breach of this duty of care entitles the claimant to make a personal injury claim.

Personal injury law encompasses all kinds of physical, as well as psychological harm. In addition to the specific injury itself, awards for compensation also reflect loss of earnings, your ability to work in the future and emotional or mental distress. Specialist personal injury lawyers will be able to indicate whether you have a strong case to make a successful claim and the process involved in pursuing your claim, from gathering evidence to how your claim will be funded.

How Will I Fund a Personal Injury Claim?

In order to make a successful accident claim, it will be necessary to gather sufficient evidence, engage in ongoing communication and negotiations with the other side and liaise with experts and third parties in obtaining relevant reports and necessary documentation, all of which come at a cost.
The costs involved in pursuing a personal injury claim should not be a barrier to doing so. If you have suffered harm through no fault of your own, you should be able to seek the financial justice owed to you without fear of any risk posed to your personal finances. At Personal Injury Claims Leeds, we can help you win the compensation you deserve without having to worry about putting your personal finances at risk.

no win no fee

What Is No Win No Fee?

In order to protect the claimant’s personal finances, many firms provide their services on a ‘No Win No Fee’ basis. This usually means that to safeguard against paying legal costs for an unsuccessful claim, an insurance policy is taken out to cover any legal fees. If your accident claim is successful, the specific terms of the agreement between you and your lawyer will outline who is responsible for covering legal fees. This normally involves negotiating with the other side or making a request in court that they pay the costs involved in bringing a successful claim.

It is vital that you are fully aware of the terms and conditions that you are entering into prior to pursuing your claim (you can’t automatically assume that No Win No Fee is part of your agreement). Our team of experts at Personal Injury Claims Leeds are committed to ensuring our clients receive as much of the compensation awarded as possible and work hard to recover any legal fees from the other side.

What Type of Personal Injury Can I Claim for?

The first misconception about making a personal injury claim is that the matter will go to court. In fact, very few personal injury cases (or other litigation for that matter) actually make it as far as a court room because it is expensive, not only for both sides but also for the public purse. This is because the defendant either manages to prove that they were not liable in which case the personal injury solicitor** is likely to advise their client that they should not go to Court. Or, most likely, the claimant manages to establish liability and the parties agree a settlement, which is encouraged by the Courts and who will penalise a party for not attempting to reach a settlement and allowing the matter to reach trial.
